About Oliver Cleary

Mr. Cleary is the son of Irish immigrants and a first generation American. The Navy brought his father and mother to this country in 1959. After graduating from the Bishop's School in La Jolla, California, Mr. Cleary attended Tulane University receiving his Bachelor's degree in Political Science in 1989.

Mr. Cleary continued his studies at Tulane University Law School, graduating in 1992. He returned to California and focused his practice to the defense of those accused of criminal conduct.

Mr. Cleary is a member of the California Attorneys for Criminal Justice, the National Association of Criminal Defense Lawyers, the Greater San Diego Business Association, and a Board Member of the Tom Homann Law Association, San Diego's Gay and Lesbian Bar Association.

Know Your Rights

If you are the subject of a criminal investigation or accusation, you must not speak to anyone; including your partner, friends, or family; without first conferring with an attorney. Often, disclosures of any kind can be misunderstood, construed, or taken out of context when repeated or retold, and though it may be accidental, this can strengthen a pending case/investigation against you.

When asked, just say that your attorney has advised you not to discuss the matter until after it has been resolved. If police ask you to discuss the matter, simply tell them that you want counsel present before you answer any questions, or recite the Alternative Miranda Card which can be printed out for future reference.
